Memorandum of Agreement between Aleister Crowley and William Rider and Son to Publish Crowley's Translation of Eliphas Levi's The Key of the Mysteries
MEMORANDUM OF AGREEMENT made this 26th day of October 1922 between Aleister Crowley Esquire, of Collegium ad Spiritum Sanctum, Cefalù, Sicily (hereinafter termed the author) of the one part, and William Rider & Son Limited, of 8 Paternoster row, London, E.C.4 (hereinafter termed the publishers) of the other part, WHEREBY, in consideration of the terms and conditions hereinafter expressed, it is mutually agreed between the parties hereto for themselves and their respective executors, administrators and assigns, or successors, as the case may be, as follows:—
(1) The publishers undertake to publish at their own risk a translation by the said author of
The Key of the Mysteries, by Eliphas Levi.
(2) The publishers shall during the legal term of copyright have the exclusive right of producing and publishing the work in book form in the English language, and shall have entire control of the publication sale and terms of sale of the work.
(3) The publishers agree to pay to the author a royalty of ten per cent on the first 1500 copies of the book sold, thirteen copies in every case being reckoned as twelve, and a royalty of fifteen per cent thereafter. Half royalty only shall be paid on export copies. The sum of £26-5-0 shall be paid to the author on account of royalties on signature of this agreement.
(4) The copyright of the work shall be the joint property of the author and publishers.
(5) In the event of the demand for the work ceasing the stock may be remaindered by the publishers at such price as they can obtain and the proceeds be retained by them less a rebate of 10 per cent which shall be paid the author. The author shall in such case have first refusal of purchase of the entire stock. The book shall not be remaindered without the consent of the author within three years of the date of publication. In the event of the book being remaindered the copyright shall revert to the author, in which case the publishers' exclusive right of producing and publishing the work shall lapse forthwith.
(6) The author shall be entitled to purchase copies of the book at 25 per cent off the published price, and shall receive six free copies of the book on publication.
(7) The publishers shall make up accounts to June 30 and December 31 in each year and deliver same to the author within ten weeks thereafter, and pay the balance if any due to the author on the account.
(8) The author undertakes to revise and see through the press the first edition of the work, and to give such reasonable amount of assistance in connection therewith as may be desired by the publishers.
