My dear Kyllmann,

 

I am in receipt of your letter of yesterday with the four chits.

     

Chit No. 1. All these sums have to be paid by Crowley and a good deal more because O'Connor & Co's taxed bill includes more than the £136.1.0 which was allowed for counsel's fees. Constables are under no liability to O'Connor but if Crowley does pay they will, I assume, repay to Constables the £136.1.0.

     

Chit No. 2. Both these items are payable in addition to our charges.

     

Chit No. 3. Our charges come to a good deal more than £327.8.9 but I intended to suggest that if Crowley does not pay we should not charge you more than the £327.8.9. It is true that there was a great deal of work involved but on the other hand we recognise that it will have been a heavy loss for you. If Crowley pays then I think we might very well charge you something more.

     

Chit No. 4. This is difficult to say. If a new trial is ordered the costs of the application will await the result of the new trial. If a new trial is not ordered the application will be dismissed with costs to be paid by Crowley. What these costs would amount to depends mostly upon what fees we have to mark on counsel's briefs but I should hope that the £100 in Court would go a long way to cover it.
