Reference is made to my memorandum in the above captioned matter which indicated that an effort had been made to obtain the opinion of the Department of the Air Force regarding the classification as to certain documents, and as to whether or not the documents could be introduced as evidence in the event of prosecution in the above captioned matter. As indicated in the reference memorandum, the representative of OSI advised [Redacted] that this was a question under the jurisdiction of the Army.
There is attached hereto a memorandum to the attention of Mr. Reynolds entitled, "Classification of Documents," dated April 6, 1951. It encloses a copy of the memorandum prepared for OSI by the Air Force dated February 20, 1951, as well as for the four Bureau reports which were loaned to G-2 iun this matter, and the thirteen items in question.
The memorandum indicates that Items 1-6 and 9 and 10 are unclassified. Item 7 is classified as "restricted," and Items 8, 11, 12 and 13 are "confidential." The memorandum further indicates that there is no objection to Items 1-7, and 9 and 10 being used as evidence. However, since the information in Items 8, 11, 12 and 13 relates to current confidential research and development, they should not be divulged to unauthorized persons.
RECOMMENDATION:
It is recommended that this be forwarded to the Espionage Section for their information.
