Rebulet 1-19-51, advising you that the facts in this case have been presented to the Criminal Division of the Department for an opinion as to prosecution.
For your information, the Department has advised that the facts indicated a possible violation of Sections 793 and 794 of Title 18, U.S. Code, but before rendering a decision as to whether prosecution would be warranted, the Department requested that steps be taken to ascertain whether the documents involved "relate to the national defense," and whether, in the event of prosecution, the Department of the Army would have any objection to these documents being introduced as evidence.
These questions were submitted to the Department of the Army, and in a confidential memorandum dated April 6, 1951, answers were furnished by Colonel Paul G. Cramer, GSC, Chief, Security Division, G-2, Department of the Army, Washington, D.C. A copy of the Army's memorandum is attached hereto for your information.
Also attached for your information is a copy of the Bureau's memorandum to the Department dated May 7, 1951, requesting that the Department advise whether, in view of the above, prosecution in this case is warranted.
When a reply is received from the Department, you will be advised.
